ASFINAG prevails against international grey-market suppliers of digital vignettes with GEISTWERT – Vienna Higher Regional Court upholds the judgement and its publication

The Vienna Higher Regional Court has upheld in full the judgment of the Vienna Commercial Court against the Polish operator of numerous vignette online shops and its managing director. The decision is final and enforceable. The defendants are prohibited from selling ASFINAG’s digital toll products without clearly stating the toll rates and surcharges, or from offering them in breach of ASFINAG’s resale restrictions. Particularly noteworthy is the order to publish the judgement not only in the ‘Kronen Zeitung’ and the ‘Standard’, but also on a total of 17 websites operated by the defendants:

In particular, the court confirmed that the defendants had offered digital toll products in breach of ASFINAG’s terms and conditions and without sufficient price transparency, and that ASFINAG had successfully defended itself against the commercial resale of its products, which was in breach of contract. The claims regarding the publication of the judgement were also recognised as justified.
