On November 20, 2015 an expert meeting with judges of the German trademark courts, the event “Meet the Judges”, which was organized by MARQUES (www.marques.org), the European association for trademark owners. took place in Munich.
Constantin Kletzer attended for GEISTWERT , and discussed with the numerous participants from German law firms and industry as well as the lecturers judges current issues of German and European trademark law. Currently, there are some new tendencies; the psychology of perception seems to take more and more influence on trademark laws. For example, if a consumer at the supermarket spots two products side by side, does he notice more the design of the packaging or the brand, and, if the latter, does he indeed recognized the word element of the trademark, or does he only “see” the graphic design. There are recent neuroscientific findings nowadays that were not yet available a few years ago. Trademark law remains exciting!
