Other Trademark Protection

Did you know that your company name displayed on the company’s sign is also protected? It’s as simple as that. However, this protection is usually not very extensive unless you have a website through which you sell products internationally. In that case, the situation may be very different.

Along with trademark protection, signs may be protected as well, in particular through protection of names (§ 43 ABGB), names of establishments or infrastructure as “non-registered trademarks“(§ 9 Act against Unfair Practices), as a company (§ 37 Austrian Commercial Code), title (§ 80 Copyright Act), variety denomination (§ 14 Variety Protection Law) or as a geographical indication or protected designation of origin (§ 68 Trademark Protection Act).
