The Italian Suprema Corte di Cassazione, in its judgement 1861 of February 2, 2015 confirmed the infringement of Natuzzi’s trademark Divani & Divani (meaning Sofas and Sofas) for Sofas by its competitor’s trademark Divini & Divani, also for sofas, such as a violation of the Italian Unfair Competition Act.
The court ruled that also common words can serve as trade marks, provided they do not describe the quality of the products or services for which they seek protection but encompass a fanciful combination in relation to them.
