The German Federal Supreme Court (Bundesgerichtshof – BGH) in its judgment I ZR 222/13 of December 10, 2015 allowed the health claim “Lernstark“ (which describes children who learn quickly and easily) under Art 10 para 3 of the Regulation (EC) No 1924/2006 on nutrition and health claims made on foods.
Also the hint “with iron […] to support the power of concentration“ was considered admissible.
