Grounds of German appeal against Unitary Patent Court unveiled

The Federal Constitutional Court ordered a stop of the ratification process for the following reasons:

• It is claimed that there was no qualified majority in the Bundestag
• There could be democratic deficits and deficits in rule of law with regard to the regulatory powers of the organs of the UPC
• The judges of the UPC were not independent nor do they have democratic legitimacy
• Violation the principle of openness towards European law

As about a number of smaller countries, the UPC must also be ratified by France and Germany and (so far) the UK, for the moment, the UPC is on hold not only for the Brexit.
