Further guidance on the identifiability of medicinal products

Yesterday, the Austrian Supreme Court published a judgment on pharmaceutical advertising, which provides further guidance on when information relating to human health or diseases does or does not refer – directly or indirectly – to a specific medicinal product.

A campaign on pneumococcal pneumonia, which was supported by the two pharmaceutical companies, that offer respective vaccines, does not become inadmissible solely because one of these companies simultaneously provides advertising material for its vaccines to health care professionals (Austrian Supreme Court on October 21, 2014 –4Ob96/14t).
