JUVE IP Austria 2019

GEISTWERT: The boutique more and more evolves into one of the first addresses in the Vienna IP-market. This is not only supported by their partner-based approach, but also by their intensive counselling at the interface of IP- and IT-law. The partners thereby demonstrate their IT-savviness, e.g. when developing IT-supported research-tools for clients, which, however, partially have yet to prevail on the market. In the meantime, Constantin Kletzer and Rainer Schultes have gained a remarkable presence in the market for their representations in patent litigation matters. The latter often represents pharmaceutical companies in active and passive litigation. The former has recently gained attention for representing Tele Tan against Austrian banks. All partners furthermore advise in trademark- and unfair competition law matters. Dr. Max Mosing made a name for himself in copyright law. Moreover, the firm’s representation of a soft drink manufacturer and a German car producer has shown that the firm, in its fifth year of operation, has evolved into an advisor of reputable trademark owners from the industry. The firm’s approach of advising their clients by their own partners’ hands still is the boutique’s signature feature. In the midterm, however, GEISTWERT will have to think about cultivating younger lawyers for satisfying international clients’ needs, particularly in patent litigation. Strengths: Consistent focus on IP-topics with partner-centred approach; infringement proceedings regarding pharma patents. Often recommended: Dr. Max Mosing, Alexander Schnider (“technically one of the best, very creative writs”, competitor), Constantin Kletzer, Rainer Schultes, Juliane Messner. Focusses: Extensive consultation in trademark-, design- and unfair competition law. Focus on patent infringement litigation in the pharma- and automotive-industry. Additionally, consultation of the tourism- and automotive-industry. Also trademark portfolio management (approx.. 900 trademarks).
