BRONCHIPLANT = BRONCHIPRET?
La Corte Suprema Austriaca ha considerato i marchi „BRONCHIPLANT“ e „BRONCHIPRET“ confondibili. Ha escluso correttamente la parte „BRONCHI“ per essere descriptiva dalla sua evaluazione ma ha allo stesso tempo concluso che „PLANT“ a „PRET“ siano confondibili (Corte Suprema 4Ob191/14p).
Ci chiediamo se eventualmente BRONCHI non abbia fatto la sua parte.
